Terms of Service
The agreement between Morsl and the restaurants and diners who use the platform.

1. Who you are contracting with
The Morsl platform at morsl.food is operated by dotbm, a company registered in Bermuda. In these terms, “Morsl” means the platform, and “we” and “us” mean dotbm.
“Restaurant” means a business that uses Morsl to publish a menu and receive orders. “Diner” means a person who places an order through a Restaurant’s Morsl ordering page. “You” means whichever of those applies to you.
2. Accepting these terms
By using the platform, as a Restaurant taking orders or as a Diner placing one, you agree to these terms. If you do not agree with them, do not use the platform.
If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.
3. What the service is
Morsl provides Restaurants with:
- A hosted ordering page that Diners open from a QR code, a direct link, or a widget embedded in the Restaurant’s own website
- A live order board showing incoming orders and their progress through service
- A dashboard for managing menus, items, pricing, availability, and opening hours
- Card payment collection at checkout, where enabled
Morsl is a technology provider, not a restaurant. The Restaurant sells the food, sets its own prices, prepares every order, and is responsible for the order being what the Diner asked for. We provide the software the sale happens through.
4. Early access
Morsl is currently in early access. That has real consequences you should understand before relying on it:
- Features may change, move, or be withdrawn as the product develops
- We do not offer a guaranteed uptime commitment during early access
We will give Restaurants reasonable notice of changes that materially affect how they take orders.
5. Fees
Morsl charges a 5% service fee on each online order, added to the Diner’s order at checkout. Nothing is taken from the Restaurant’s menu prices. The fee reaches the Restaurant’s merchant account with the order, and we invoice the Restaurant for it monthly, with a minimum of USD 75 a month. There is no setup fee, and we do not invoice the service fees or the minimum for a Restaurant’s first month after it goes live. The restaurant website and the mobile app are optional add-ons charged monthly from the start, and can be cancelled any month. Current pricing is published on our pricing page. Where a Restaurant has a separate written agreement with Morsl, the fees in that agreement apply instead.
Card payments go through the Restaurant’s own Authorize.Net payment gateway to its bank’s ecommerce merchant account. Their fees and settlement timings apply in addition to anything agreed with us.
Any fee charged to a Diner at checkout is shown to the Diner before the order is confirmed. We do not add undisclosed charges at checkout.
6. Restaurant responsibilities
If you use Morsl to take orders, you are responsible for:
- Holding and maintaining every licence, permit, and food-safety registration your jurisdiction requires
- The accuracy of your menu: prices, descriptions, allergen and dietary information, and what is actually available
- Preparing and fulfilling orders you accept, and telling Diners promptly when you cannot
- Handling your own tax obligations on the sales you make through the platform
- Keeping your account credentials secure, and the actions of everyone you give access to
Allergen information is your responsibility. We give you the fields to publish it; we cannot verify what you enter, and a Diner relying on it is relying on you.
7. Diner responsibilities
When you place an order through Morsl, you agree to:
- Give accurate contact and collection or delivery details
- Pay for the order you place
- Raise any problem with the food, the order, or a refund with the Restaurant, which is the seller
We will help where we can with problems caused by the platform itself.
8. Acceptable use
You may not:
- Use the platform for anything unlawful, or to sell anything you are not licensed to sell
- Attempt to gain access to accounts, data, or systems that are not yours
- Interfere with the platform’s operation, including by automated scraping or load that degrades service for others
- Copy, resell, or white-label the platform without our agreement
9. Intellectual property
The Morsl name, branding and this website belong to dotbm. The ordering software is licensed from our technology provider. Using the platform does not transfer any of that to you.
Your content stays yours. Your menu text, photography, and branding remain your property; you grant us the limited licence we need to display them on your ordering page and in the platform, and you confirm you have the right to use whatever you upload.
10. Data protection
We handle personal information in line with the Personal Information Protection Act 2016 (PIPA). Our Privacy Policy explains what we collect and why, and our Data Processing Policy sets out which of us is responsible for which data. The distinction matters because Diner order data belongs to the Restaurant, not to us.
11. Availability and support
We work to keep the platform available and will tell Restaurants about planned maintenance where we reasonably can. During early access we do not commit to a specific uptime figure.
12. Limitation of liability
The platform is provided as is. To the maximum extent permitted by Bermuda law, we are not liable for:
- Food quality, food safety, or anything else about the food itself; that sits with the Restaurant
- Lost profits or lost business arising from an interruption to the platform
- The acts or omissions of third parties, including payment providers and internet service providers
- Loss caused by your failure to keep your account credentials secure
Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, for fraud, or under consumer protection law.
13. Suspension and termination
A Restaurant may stop using the platform at any time. We may suspend or end access where these terms are breached, where use of the platform is unlawful, or where continuing would put Diners at risk. Where circumstances allow, we will give notice first.
On termination, we will give a Restaurant a reasonable opportunity to export its menu and order data before it is deleted, in line with the retention periods in our Privacy Policy.
14. Governing law
These terms are governed by the law of Bermuda, and the courts of Bermuda have jurisdiction over any dispute. We would always rather resolve a problem by talking to you first: write to hello@morsl.food.
15. Changes to these terms
We may update these terms as the product and the business develop. The date at the top of this page shows when they last changed. Where a change materially affects Restaurants, we will tell them directly rather than relying on this page alone.
